Restrictions on Foreigners in the Human Genetic Resources Regulation

Important reminder: The People's Republic of China Human Genetic Resources Regulation (implemented 2019, revised 2024), Implementation Rules for Human Genetic Resources Regulation (implemented 2023), and Biosecurity Law of the People's Republic of China (implemented 2021) have strict restrictions on foreigners:

Prohibited Activities

  • Foreign organizations, individuals, and institutions they establish or actually control must not collect or preserve Chinese human genetic resources within China
  • Must not provide Chinese human genetic resources to overseas parties
  • Buying and selling human genetic resources is prohibited
  • Must not mail samples for testing, must not bring samples collected overseas into China for testing

Exceptions

  • Human materials collected during clinical diagnosis and treatment activities are not covered by the regulation
  • International cooperative scientific research approved by the Ministry of Science and Technology

Legal Liability

  • Responsible individuals: Maximum fine of 500,000 yuan; serious cases prohibited from related activities for 1-5 years
  • Institutional violations: Fine of 1-10 million yuan; serious cases result in license revocation
  • Buying/selling human genetic resources: Fine of 1-10 million yuan
  • Serious cases constituting criminal offenses will be pursued for criminal liability according to law
